1. GENERAL CONDITIONS OF INSURANCE PURCHASE

1.1 Introduction

1.1.1 We are Easy Kuba, the brand name of a public limited company registered in Santa Marta Magdalena (COLOMBIA) with registration number B85212432. From now on, the term "we" will refer to Easy Kuba while "you" will refer to the customer, understood as all the persons indicated in the booking, including those added or replaced on subsequent dates.

1.1.2 Please read these conditions carefully. By selecting "I have read, understood and accept the booking conditions" you agree to abide by these conditions and confirm that you have the authority to accept these terms on behalf of all persons included in the group.

1.1.3 These terms and conditions contain in their entirety the agreement between Easy Kuba and the customer and replace any previous understanding or agreement (both oral and written) on the subject and cannot be corrected or modified unless expressly agreed in writing with Easy Kuba.

1.1.4 These terms and conditions contain certain exclusions and limitations of liability. If any part of the conditions proves invalid or unenforceable, the rest of the conditions will remain valid. The invalid or unenforceable condition will be replaced by a valid and applicable alternative expression that has the same meaning.

1.1.5 Easy Kuba is an intermediary agent duly authorized to sell travel insurance for tourists issued by the Cuban company ESICUBA SA through its subsidiary ASISTUR SA

1.1.6 Insurance companies are independent companies and not agents or employees of Easy Kuba. Easy Kuba is not responsible for the acts, errors, omissions, warranties, infractions or negligence of any of these suppliers, as well as for personal or property damage, death or other damages and costs arising from the above. Easy Kuba is not responsible and will not return money for the total or partial non-fulfillment of its contractual obligations, when they are impossible to fulfill due to force majeure or fortuitous events, understood as extraordinary, unpredictable or foreseeable events, inevitable or deriving from an event natural, strikes or other causes beyond its direct control and will not be liable for any additional expenses, omissions, delays

1.2 Procedure for Insurance

1.2.1 After placing an order on our site www.easykubcover.com, you will receive an e-mail from us confirming that we have received your order. The contract between us will only be entered into when we send you this acceptance email.

1.3 Obtaining Insurance

1.3.1 When Easy Kuba sends you Insurance for Cuba, it is important that you confirm that you have obtained all the Insurance for your trip. You must notify us immediately by email if you find any discrepancies in the documentation.

1.4. Sending Insurance

1.4.1 Easy Kuba will send the Insurances in PDF format to the e-mail address you provided during the purchase.

1.4.2 No shipping costs by courier will be added to your order (if it is only Insurance)

1.4.3 Insurances are issued on the same day they are received, provided the order is placed before 2pm CEST. Orders placed after 2pm CEST will be shipped on the following business days.

1.5 Cancellations and Refunds

1.5.1 If you wish to cancel your order, you can do so if your insurance has not yet been issued.Any request for cancellation or modification must be sent to us in writing, by sending an e-mail to info@easykuba.com and will take effect from the day of receipt.

1.5.2 All cancellations and refunds will be subject to a 10% penalty, used to cover bank fees to process cancellation or refund.We usually issue Insurance within 1 business day of payment, but these times may vary, so please contact us to see the status of your order.

1.6 Cancellation policy

1.6.1 Insurance can be canceled within 14 days of issue without specifying the reason, always within at least 48 from the start date of the insurance coverage.

1.6.2 All refunds will be subject to a 10% cancellation fee, used to cover bank fees to process cancellation or refund

1.7 Disclaimer

1.7.1 When sending your travel documents, it is your responsibility to verify that all tourist cards required for your trip have been obtained, that the insurances have the correct dates of entry and exit from Cuba, that your personal details are reported carefully and that your passport is valid for at least six months after the completion of your trip.

1.7.2 Please note that even when a visa is issued, a traveler may be denied entry as in each country local immigration officials make the final entry decision.

1.8 Limitation of Liability

1.8.1 In case of loss, loss, damage, delay or destruction of a tourist card, Easy Kuba will be liable only in case of fault and its liability will be limited to the basic replacement cost of that item. Easy Kuba is not responsible for items lost, damaged, delayed or destroyed by a delivery service or issuing authority. To the fullest extent permitted by law, Easy Kuba excludes or limits any direct, indirect or consequential loss and all legal or implied conditions and warranties, including, without limitation, lost profits or travel or vacation costs or any loss arising from information obtained from the website. Subject to the other provisions of this clause, our utmost liability for loss caused to you is by contract, illicit act or other, the level of commissions paid by you will be limited to non-consumers; for Consumers, losses and damages up to a maximum of 250 Euros for which Easy Kuba is directly responsible and which can be totally attributable to incorrect provision of the service.

1.9 General

1.9.1 These terms and conditions and any documents expressly referenced constitute the entire agreement between us and supersede all prior discussions, correspondence, negotiations, prior agreements, understandings or agreements between us relating to the subject matter of any contract. If any provision of these Terms does not comply with any law, the provision must be read in a way that gives it the greatest effect possible. If it is not possible to give the provision any effect, then it must be considered severable from the rest of the Terms. Where Easy Kuba is unable to fulfill any obligation under the contract due to any circumstance, matter or thing beyond its reasonable control ("force majeure"), we will be released from such obligations to the extent of such prevention, restriction or interference in a manner caused. Easy Kuba may subcontract all or part of its obligations or assign all or part of its rights under this contract. This agreement does not create any enforceable right by a person who is not a party to it, except for any legitimate successor or transferee.
